These terms apply to your use of xygenyx.com. If you do not accept them, please do not use the site.

What this site is, and is not

This site describes what Xygenyx does. It is information, not an offer. Nothing here creates a contract, a quotation, or a commitment to enter into one. The terms of any engagement are set out in a signed agreement, and only in a signed agreement.

Descriptions of capability are general. What is included in any particular engagement — including who owns resulting intellectual property — is negotiated case by case and has no default position.

Products described on this site

Xygenyx develops and formulates products that reach consumers under other companies’ brands. Where a product is named here, we are describing development work we performed. We are not offering that product for sale and we make no claim about what it does for anyone who uses it.

Product claims are the responsibility of the brand that sells the product. For questions about a product you have bought, contact the brand that sold it to you.

Nothing on this site is medical advice, and nothing here has been evaluated as a claim to diagnose, treat, cure or prevent any disease.

What you send us

Please read this before describing a product idea in the inquiry form.

Unless we have signed a confidentiality agreement with you covering it, anything you send us through this site is not confidential. We work across many categories, and we may already be developing — or may later develop — something similar, independently of you. Sending us an idea creates no obligation on us, gives you no rights in our work, and entitles you to no compensation.

If you want to discuss something confidential, tell us that first and we will put an agreement in place before you send it.

You are responsible for what you submit. Do not send anything unlawful, anything that infringes someone else’s rights, or anyone else’s personal information without their permission.

Our content and marks

The text, design, images and code on this site belong to Xygenyx or our licensors. You may read the site, and share links to it. You may not copy, republish or adapt it for commercial purposes without our written permission.

Xygenyx, the Xygenyx device, and the product names shown belong to Xygenyx or to the brands that own them. Nothing on this site grants you a licence to use any of them.

Links to other sites

Where we link to another company’s site, we do not control it and we are not responsible for it. Their terms and their privacy policy apply once you are there.

Availability and accuracy

We aim to keep this site accurate and available, but we do not guarantee either. Content may be out of date, and the site may be unavailable at times.

To the fullest extent the law permits, the site is provided as is, and Xygenyx is not liable for indirect or consequential loss arising from your use of it, or from reliance on anything published here.

Governing law

These terms are governed by the laws of the State of California, and the courts of California have exclusive jurisdiction over any dispute arising from them.

Changes

We may update these terms. The version published here is the one that applies.
